Percentages are computed from the filings, not estimated. - [The claim that never gets decided](https://hurricanelaw.pro/denials/patterns/delay/): 73.1% of filings (1,383). No denial, no payment, no determination. Months pass. Delay costs the carrier very little and costs the policyholder a house that stays broken, and it is the single most common allegation in the record. - [The estimate that comes in low](https://hurricanelaw.pro/denials/patterns/undervalued-estimate/): 40.9% of filings (774). Coverage is accepted and the number is not. The carrier writes an estimate far below what the repair costs, and because the claim was never denied there is no denial letter to attack, only a figure. - [The decision made without a real look](https://hurricanelaw.pro/denials/patterns/no-inspection/): 28.9% of filings (546). A coverage position reached from a desk, a drive-by, or a walk-through short enough that most of the loss was never scoped. The filings describe adjusters who did not enter the property, did not get on the roof, or did not return after the first visit. - [Storm damage called age](https://hurricanelaw.pro/denials/patterns/wear-and-tear/): 28% of filings (529). Storm-creased shingles are reclassified as deterioration, and a covered peril becomes an excluded condition. It is the most common wind denial in Florida because roofs genuinely do age, and a photograph taken months later cannot easily tell the difference. - [The retained engineer](https://hurricanelaw.pro/denials/patterns/engineer-report/): 18.4% of filings (348). An engineering report arrives with the denial. It carries a licence number and professional letterhead, and it is paid for by the insurer. The report usually concedes the damage exists; what it does is attribute the cause to something the policy excludes. - [The claim file you cannot get](https://hurricanelaw.pro/denials/patterns/claim-file-refusal/): 15.6% of filings (295). The policyholder asks for the estimate, the photographs, the engineering report, the adjuster notes. The carrier does not produce them. Without the file there is nothing specific to answer, which is the point. - [Priced under the deductible](https://hurricanelaw.pro/denials/patterns/below-deductible/): 6.2% of filings (117). The carrier agrees the storm damaged the house, prices the repair below the hurricane deductible, and pays nothing. No exclusion has to be defended and no causation theory has to hold up. Everything rests on one document the letter rarely encloses: the estimate. - [Blamed on how it was built](https://hurricanelaw.pro/denials/patterns/workmanship-exclusion/): 4% of filings (76). The damage is real and the cause is assigned to design, workmanship, construction or maintenance, all of which the policy excludes. It moves the loss from the storm to the building itself. - [Defeated by the calendar](https://hurricanelaw.pro/denials/patterns/late-notice/): 1.9% of filings (35). Notice arrived late, and Florida presumes the insurer was prejudiced by the delay. The presumption can be rebutted, but the burden sits entirely on the policyholder. - [Wind moved into the water exclusion](https://hurricanelaw.pro/denials/patterns/water-exclusion/): 1.1% of filings (21). A homeowners policy covers wind and treats water pushed ashore as flood. Calling the cause surge, flood or surface water moves the entire loss outside the policy in one sentence, without denying that damage exists. - [Mold capped after a covered loss](https://hurricanelaw.pro/denials/patterns/mold-exclusion/): 0.5% of filings (10). Water damage is accepted and the mold that followed is capped by a sublimit or excluded outright, often with an argument that the policyholder should have prevented it. - [The carrier picks the contractor](https://hurricanelaw.pro/denials/patterns/managed-repair/): 0.5% of filings (9). Instead of paying the loss, the insurer offers to repair it through its own network. The contractor works to the carrier estimate, and the scope of the repair becomes the carrier decision. ## Denial filings by peril Archive slices.
