HOME / DENIALS

Claim denied? Denials are arguments, and arguments lose.

A denial letter is not a ruling. It is the carrier’s opening argument: a paragraph of policy language applied to facts they gathered in one site visit. Arguments can be answered, and the same ones come back. Every argument below has a page that says what it is, why it fails, and what beats it.

WHAT A DENIAL ACTUALLY IS
  • A denial is the start of the file, not the end. Reopened claims with new evidence get paid.
  • Search 1,891 Florida claim-denial filings by insurer, peril and argument. Median $76,344 at stake per claim.
  • The same 12 arguments repeat. Delay leads at 73.1% of filings, then the low estimate, then storm damage called age.
  • Real denial language in the public file, each document labeled by what it actually is and linked to its source.
  • The letter must cite specific policy language and a factual basis. Vague denials are deficient.
  • Your deadlines run from dates on that letter. Keep the envelope.

WHERE THIS LEAVES YOU

A denial is one carrier's opinion, and it is often wrong

A denial or lowball payment is a starting position, not the final word on what your policy owes. Carriers deny for a short list of reasons: an excluded cause, pre-existing or long-term damage, late notice, or thin proof of loss. Each has a standard rebuttal built from documents you already hold: the policy, the adjuster's report, dated photos, and a weather record.

Start with the reason on your letter. A roof denial blamed on age is rebutted with pre-storm condition and measured wind speed; a short check often traces to withheld depreciation owed once repairs are done; interior water blamed on seepage is frequently wind-driven rain through a storm-created opening, which is covered. Timelines run from the date of loss and do not pause while you argue, so check the filing deadlines first. A denial built on a delayed or incomplete inspection can also support a bad-faith claim. The free claim review below reads your letter and evidence line by line.

Denied or underpaid? Fight it with the carriers’ own playbook.

LICENSED · SOUTH CAROLINALICENSED · FLORIDA

Halversen Law is a property-insurance law firm licensed in South Carolina and Florida that represents policyholders, never carriers. Since 2008, the firm has taken on denied, underpaid, and delayed claims across the full range of storm and property losses: wind and hurricane damage, water disputes, roof claims, and commercial and condominium losses. Its attorneys spent the early part of their careers defending insurance companies, and now use that inside knowledge of the carrier playbook, how an adjuster builds a denial and where the file is weak, to fight for the policyholder on the other side of it. Cases are handled on contingency: no fee unless you recover.
