Matching law: when a partial roof repair can mean a full replacement

If replacement shingles or tiles don't reasonably match what's already there, some states require the carrier to make things uniform, sometimes a full slope or roof.

A storm damages part of a roof. The carrier approves patching just that section. But the new shingles don’t match the sun-faded ones around them, or the discontinued tile can’t be sourced. “Matching” law is the rule that can turn a patch into a larger, sometimes full, replacement.

The idea behind matching

When repaired or replaced items are visible and adjoining, some policies and statutes require the result to be reasonably uniform in appearance. If a patch would leave a mismatched checkerboard, the argument is that a “repair” that looks obviously patched isn’t really a repair to like kind and quality.

Florida addresses this by statute for certain losses. Fla. Stat. § 626.9744 governs how carriers handle repairs where matching is at issue, and many policies contain their own matching or “line of sight” language. The details vary, and reforms in recent years have changed how some provisions apply.
