IN THE DENIAL RECORD

We read 1,891 Civil Remedy Notices filed against Florida property insurers over denied claims. 31 of them name Florida Peninsula Insurance (NAIC 10132).

Saint PetersburgACCEPTED 12/20/2024$749,271

FPIC ESTIMATED THE AMOUNT FOR REPAIRS TO BE $1,079.88, AND FOOD LOSS IN THE AMOUNT OF $500.00, FOR A TOTAL CLAIM AMOUNT OF $1,579.88. THE INSURED'S ADJUSTER ESTIMATED THE FULL COST OF RETURNING THE PROPERTY TO ITS PRE-LOSS CONDITION TO BE $749,271.88. INITIALLY AND IMMEDIATELY THE FULL VALUE OF THE PUBLIC ADJUSTER'S ESTIMATE, $749,271.88, LESS ANY APPLICABLE DEDUCTIBLE.

TampaACCEPTED 12/5/2024$237,227

On November 21, 2024, the carrier made the unilateral determinations that A) the damages to the property, including the interior would be excluded under the policy and therefore be denied and that B) the damages that were covered failed to exceed the deductible on the policy and that the insured would be entitled to $0 after the application of the deductible. The insured has been compelled to obtain an independently adjusted estimate totaling in the amount of $237,227.74 that would be needed to repair the property back to its pre-loss condition. Therefore, to cure the defects outlined in this Civil Remedy Notice, the carrier must: 1) Pay the complete covered loss in the amount of $237,227.74 less any applicable policy deductible; and 2) Pay the statutory interest on the amount of unpaid damages from the date of loss to the date payment is finally made.

Counts are filings naming the insurer, matched on NAIC code. They follow book size as much as behaviour: a carrier with more Florida policies collects more filings. Each is an allegation by a policyholder, not a finding.

Denied or underpaid? Fight it with the carriers’ own playbook.

LICENSED · SOUTH CAROLINALICENSED · FLORIDA

Halversen Law is a property-insurance law firm licensed in South Carolina and Florida that represents policyholders, never carriers. Since 2008, the firm has taken on denied, underpaid, and delayed claims across the full range of storm and property losses: wind and hurricane damage, water disputes, roof claims, and commercial and condominium losses. Its attorneys spent the early part of their careers defending insurance companies, and now use that inside knowledge of the carrier playbook, how an adjuster builds a denial and where the file is weak, to fight for the policyholder on the other side of it. Cases are handled on contingency: no fee unless you recover.
